MORPHE Guess the Jar Giveaway

No purchase or payment OR ANY KIND is necessary to enter or win. A purchase or payment of any kind will not increase your chances of winning. All federal, state and local laws and regulations apply. Void where prohibited or restricted by law.

1. Binding Agreement: These are the official rules (the “Rules”) for the MORPHE Guess the Jar Giveaway (the “Giveaway”). By entering, you agree to be bound by these Rules and by the decisions of Sponsor, which are final and binding on all matters relating to the Giveaway. If there is any conflict between these Rules and any video, caption or other promotional material, these Rules control.

2. Sponsor: The Sweepstakes is sponsored by Forma Brands, LLC (the “Sponsor”), a Delaware limited liability company, located at 10303 Norris Ave Suite 225, Pacoima, CA 91331.  The Sponsor’s decisions are final and binding as to all aspects of the Sweepstakes.  Inquiries regarding the Sweepstakes should be directed to the Sponsor.

3. Eligibility: The Giveaway is open only to individuals who, at the time of entry, are legal residents of the fifty (50) United States or the District of Columbia, excluding Florida, New York and Rhode Island, are at least eighteen (18) years old and have reached the age of majority in their state of residence, and have a valid TikTok account. Residents of Florida, New York, Rhode Island, Puerto Rico and other U.S. territories are not eligible. Employees, officers and directors of Sponsor, its parent, subsidiaries and affiliates, and of its advertising and promotion agencies, any person who knows the correct number, and the immediate family members (spouse, parent, child, sibling and their respective spouses) and household members of each, are not eligible.

4. Entry Period:: The Giveaway begins when the Giveaway video is posted on the @morpheofficial TikTok account at approximately 9:00 a.m. on 10/30/26 (the “Video”) and ends at 11:59 p.m. on 11/5/26 (the “Entry Period”). Sponsor is the official timekeeper for the Giveaway. Entries received after the Entry Period will not be eligible. Any proof of submission does not constitute proof of receipt.

5. How to Enter:No purchase or payment of any kind is necessary to enter or win. During the Entry Period, watch the Video and post one (1) comment on the Video stating your guess, as a whole number, of how many Morphe lip products are in the jar shown in the Video (an “Entry”). No purchase, follow, like, share, tag or other action is required. Limit one (1) guess per person and per TikTok account. Only the first comment from an account that contains a number will count; later comments, replies, edited, deleted-and-reposted or additional guesses will not count, and Sponsor may disqualify any person who posts more than one guess or uses multiple accounts. Guesses must be stated clearly as a single whole number (for example, “142”); ranges, multiple numbers, words that cannot be read as a single number, or guesses posted as replies to other comments are not valid. Entries made by any script, bot or other automated means are void. Comments that are offensive, unlawful or violate TikTok’s Terms of Service or Community Guidelines may be removed and disqualified.

6. Winner Determination:The number of lip products in the jar was counted and recorded in writing by Sponsor before the Video was posted (the “Correct Number”). After the Entry Period ends, Sponsor will review all eligible Entries, and the potential winner (the “Potential Winner”) will be the eligible entrant whose Entry is: (a) the earliest-posted Entry that states the Correct Number; or (b) if no Entry states the Correct Number, the Entry closest to the Correct Number (whether above or below it); and if two or more Entries are equally close, the earliest-posted of those Entries. Sponsor will determine the order of posting using the comment time stamps and other data available to it from TikTok, and Sponsor’s determination is final. If Sponsor cannot reasonably determine which of two or more otherwise tied Entries was posted first, the Potential Winner will be selected by random drawing from among those tied Entries. The odds of winning depend on the number of eligible Entries received and how close each Entry is to the Correct Number. Sponsor will reveal the Correct Number in a follow-up video or comment after the Entry Period ends. One (1) Prize will be awarded.

7. A Winner is considered a potential Winner (“Potential Winner”) pending verification of eligibility and compliance with these Rules. Ten (10) Potential Winners (10 from the U.S.) will be selected at random from all eligible Entries received during the Entry Period. Odds of winning depend on the number of eligible Entries received during the applicable Entry Period. Potential Winners will be contacted via direct message from @morphebrushes on Instagram within five (5) business days after the Entry Period using the contact information given at the time of Entry. Potential Winners will have seventy-two (72) hours to respond and claim their Prize once Sponsor contacts the Potential Winner. Sponsor is not responsible for any change of email address, mailing address, and/or telephone number of an Entrant. Prize notices returned as undeliverable or if a Potential Winner cannot be contacted or does not respond within the seventy-two (72) hour time period, will result in the disqualification of the Potential Winner and an alternate Winner will be selected. If a Potential Winner fails to comply with these Rules or applicable law, the Potential Winner’s prize is forfeited and an alternative Winner will be selected. If there are no Winners by the 30th day after the end of the Sweepstakes, no further Winners will be chosen. Once a Potential Winner's eligibility is verified, he/she/they will be confirmed as a Winner. In the event of a dispute over the identity of a Winner, Entries will be deemed made by the authorized account holder of the email address submitted at the time of Entry. Within five (5) business days after the Entry Period ends, Sponsor will notify the Potential Winner by replying to the winning comment and/or by direct message from the verified @Morpheofficial TikTok account. Sponsor will only contact winners from the verified @morphebrushes account and will never ask for payment, banking information, gift cards or passwords. The Potential Winner must respond within seventy-two (72) hours and provide their full legal name, email address, shipping address, date of birth and state of residence, and may be asked to sign an affidavit of eligibility and publicity release (where permitted by law). If the Potential Winner does not respond on time, is ineligible, or does not comply with these Rules, the Prize will be forfeited and Sponsor may award it to the next eligible entrant determined under Section 6 (the next earliest correct Entry, or the next closest Entry), until a winner is confirmed or 10/29/26– about 30 days after the Entry Perio, after which the Prize may go unawarded.

8. Prizes and Their Approximate Retail Values (“ARV”): One (1) Morphe lip combo consisting of 1x signature lip pencil and 1x liplock (the “Prize”). Approximate retail value: ("ARV"): $22 The Prize will be shipped to the winner’s U.S. address within approximately One (1) to Two (2) weeks after winner confirmation. The Prize is non-transferable and may not be exchanged or redeemed for cash; Sponsor may substitute a prize of equal or greater value if any item is unavailable. The winner is responsible for any taxes. THE PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, EXCEPT ANY WARRANTY THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW.

9. Publicitu and License to Your Comment: By entering, you grant Sponsor and its affiliates a non-exclusive, royalty-free, perpetual license to display, repost and reference your comment and TikTok username on the Video and on Sponsor’s social media channels solely in connection with administering and promoting this Giveaway. Except where prohibited by law, by accepting the Prize the winner consents to Sponsor announcing the winner’s TikTok username, first name and state of residence on Sponsor’s social media channels in connection with this Giveaway, without further compensation.

10. General:Sponsor may disqualify any person who tampers with the entry process, provides false information, enters in violation of these Rules, or acts in a disruptive, harassing or unsportsmanlike manner. If the Giveaway cannot run as planned because of fraud, technical failure, platform action (including removal or restriction of the Video or its comments), or any other cause beyond Sponsor’s reasonable control, Sponsor may cancel, suspend or modify the Giveaway and, if cancelled, award the Prize under Section 6 from eligible Entries received before the cancellation. Sponsor is not responsible for comments that are not posted, are hidden or filtered by TikTok, or are posted late; for technical, network or platform malfunctions; or for printing or typographical errors. Sponsor’s failure to enforce any term is not a waiver of that term.

    By submitting an Entry and participating in the Sweepstakes, you represent and warrant that (i) your Entry is original and that you are the sole and exclusive owner and rights holder of the submitted Entry, or you have obtained the necessary permission to include the Entry in the Sweepstakes, and that you have the right and authority to submit the Entry in the Sweepstakes; (ii) your Entry does not violate any third party intellectual property or proprietary rights; and (iii) you are otherwise not in violation of any applicable laws, rules and/or regulations.

11. Severability: If any section, provision, term or clause shall be held or found to be unenforceable or invalid by a court decision, statute, rule or otherwise, the remaining provisions shall not be affected thereby and shall continue in full force and effect and such provision may be modified or severed from these Rules to the extent necessary to make such provision enforceable and consistent with the remainder of these Rules.

12. Releases and Limitations of Liability: To the fullest extent permitted by law, by entering you release and hold harmless Sponsor, its parent, subsidiaries and affiliates, and each of their officers, directors, members, employees, agents and representatives, Sponsor’s advertising and promotion agencies, and TikTok Inc. and its affiliates (collectively, the “Released Parties”), from any and all claims, damages, losses and liabilities arising out of or relating to your participation in the Giveaway or the acceptance, possession, use or misuse of the Prize. You waive the benefit of California Civil Code Section 1542 and any similar law, which provides: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” Nothing in these Rules releases or limits any liability for a Released Party’s gross negligence, willful misconduct or fraud, or any other liability that cannot be released or limited under applicable law.

13. Disputes; Choice of Law: These Rules and the Giveaway are governed by the laws of the State of California, without regard to its conflict-of-law rules. Except for claims that qualify for small claims court, any dispute arising out of or relating to the Giveaway, the Prize or these Rules will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, before a single arbitrator. The arbitration will take place in Los Angeles County, California, or in your county of residence if you so elect, or by video or telephone as permitted by the AAA rules. Sponsor will pay all AAA filing, administration and arbitrator fees to the extent required by the AAA Consumer Arbitration Rules and applicable law. The arbitrator may award any individual relief available under applicable law. YOU AND SPONSOR EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. Judgment on the award may be entered in any court of competent jurisdiction. If the class action waiver is found unenforceable as to any claim, that claim will be decided in court and not in arbitration. Notwithstanding the foregoing, any claim for public injunctive relief will be brought in a court of competent jurisdiction and stayed pending the arbitration of any individual claims.

14. Privacy Policy: Information collected in connection with the Giveaway is collected by Sponsor and is subject to Sponsor’s Privacy Policy at https://www.dahuasecurity.live/pages/privacy-policy. Sponsor collects your TikTok username and comment from all entrants and, from the Potential Winner, the contact, age and residency information described in Section 7, and uses it only to administer the Giveaway, verify eligibility, ship the Prize and comply with law. Participation does not add you to any marketing list.

15. TikTok: This Giveaway is in no way sponsored, endorsed, administered by or associated with TikTok. You are providing your information to Sponsor and not to TikTok. By entering, you release TikTok from any liability associated with the Giveaway.

16. Winner List:For the winner’s name (available after 11/5/26), send a self-addressed, stamped envelope within sixty (60) days after the Entry Period ends to: Forma Brands, LLC, ATTN: Legal Department – MORPHE Guess the Jar Giveaway, 10303 Norris Ave., Suite 225, Pacoima, CA 91331.
